Brad Gordon’s trial practice is founded on thorough and unrelenting preparation and creative problem-solving for commercial clients in complex business, financial services, securities, construction, and real estate litigation. In his 25 years of practice—including almost 10 years as a trial lawyer and shareholder in Winstead PC in Dallas—Brad has represented banks, servicers, and borrowers in workouts, foreclosures, and related litigation; public and privately held businesses and individuals in contract, tort, and fiduciary litigation; purchasers, sellers, and developers in real property disputes; broker-dealers of securities and individuals before the NASD and NYSE; property owners, developers, and homebuilders in construction disputes; and landlords and tenants in disputes over commercial real estate.

Brad’s diverse experience includes successfully defending an insurance agent against fraud and related tort claims asserted by T. Boone Pickens and Cowboy Athletics, Inc. seeking $33 million in damages; successfully defending a real estate developer in a suit for a $23 million termination fee under an interest swap agreement brought by a national bank, arising out of an $84 million dollar loan in connection with a $100 million real estate development; successfully defending the owner of an undeveloped tract in Dallas County against contract and tort claims for which a purchaser of the tract sought more than $20 million in damages; successfully representing a national bank against borrowers and guarantors in connection with loans totaling in excess of $9 million for construction projects in four different states; successfully prosecuting a motion to remove a guardian of an estate holding a controlling interest in a closely-held company worth several million dollars on the grounds that the guardian had placed himself in a position of irreconcilable conflicts of interest through control of the company as guardian; and obtaining a full defense award and recovering costs on behalf of a national broker-dealer in a multi-million dollar securities fraud arbitration.
