A unanimous jury found for Reese Marketos client Cardenas Metroplex—a Mercedes-Benz dealership in Harlingen, Texas owned by Renato Cardenas, Sr.—on all counts, awarding actual damages for fraud and misrepresentation and further finding, beyond a reasonable doubt, that Mercedes-Benz had caused Cardenas to execute a document through deception—a felony crime under the Texas Penal Code. The trial court further instructed the jury that Mercedes-Benz had destroyed, lost, or failed to produce material evidence in the case. The jury awarded punitive damages against Mercedes-Benz, its Chicago-based Regional Franchise Manager, and each of two Mercedes-Benz field representatives.
